Terms of Service

By accessing or using Morphic CI ("the Service"), operated by Pixel Familiar Inc. ("we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

We reserve the right to update these terms at any time. Continued use of the Service after changes constitutes acceptance of the revised terms. We will notify registered users of material changes via email.

Morphic CI is a testing and observability platform for AI agent endpoints. The Service generates prompt variations, intercepts JSON-RPC payloads, and calculates consistency scores to help you evaluate agent behavior.

The Service is a diagnostic tool, not a guarantee of agent correctness. Morphic CI does not warrant that agents tested through our platform will behave correctly in production, nor that all possible failure modes will be detected. You remain solely responsible for the behavior, reliability, and safety of your own AI agents and systems.

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and API keys. Notify us immediately if you suspect unauthorized access.

We may suspend or terminate accounts that violate these terms, are used for illegal purposes, or place unreasonable load on our infrastructure.

You agree not to:

• Use the Service to test agents that perform illegal activities
• Submit payloads containing child exploitation material, malware, or content that violates applicable law
• Attempt to reverse-engineer, decompile, or extract the source code of the Service
• Resell, redistribute, or sublicense access to the Service without written permission
• Deliberately overload infrastructure or circumvent rate limits

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data, including agent payloads submitted for testing.

The Service offers a free tier and paid subscription plans. Paid plans are billed monthly. You may cancel at any time; cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods.

We reserve the right to change pricing with 30 days' notice to active subscribers.

You retain all rights to the data, prompts, and payloads you submit to the Service. We do not claim ownership of your content. We use submitted data solely to provide and improve the Service.

The Morphic CI name, logo, software, and documentation are the property of Pixel Familiar Inc. and are protected by applicable intellectual property laws.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

We do not warrant that: (a) the Service will be uninterrupted, secure, or error-free; (b) test results will be accurate or complete; (c) the Service will detect all instances of agent hallucination, drift, or malfunction; or (d) the Service will be compatible with all agent architectures or protocols.

You acknowledge that AI agent behavior is inherently unpredictable and that no testing tool can guarantee the absence of defects. Do not rely on Morphic CI as your sole safeguard for production deployments.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PIXEL FAMILIAR INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total aggregate liability for all claims arising out of or related to these terms or the Service shall not exceed the greater of: (a) the total amount you paid to us in the twelve (12) months preceding the claim, or (b) fifty Canadian dollars (CAD $50.00).

This limitation applies regardless of the legal theory (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

You agree to indemnify and hold harmless Pixel Familiar Inc. from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from: (a) your use of the Service; (b) the behavior of agents you test through the Service; (c) your violation of these terms; or (d) your violation of any applicable law or third-party rights.

We aim for high availability but do not guarantee specific uptime percentages. Scheduled maintenance will be announced in advance when possible. We are not liable for downtime caused by third-party services, network conditions, or force majeure events.

Either party may terminate this agreement at any time. Upon termination, your right to use the Service ceases immediately. We may retain anonymized and aggregated data derived from your use. We will delete your account data within 30 days of termination upon written request.

These terms are governed by the laws of the Province of Manitoba, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Winnipeg, Manitoba.
